This Site and all Content are the copyrighted property of Pixel Graphics and/or its subsidiaries (referred to herein as “Amit Enterprise”) or the copyrighted property of parties from whom Amit Enterprise has licensed such property. All rights in this Site and its Content are reserved worldwide. It is strictly prohibited to retain copy, distribute, publish, or use any portion of the Content except as expressly allowed in these Terms of Use. Amit Enterprise reserves the right to add to, delete from, or modify any part of Content at any time without prior notice. Any modifications to Content, whether by you or Amit Enterprise remain the property of Amit Enterprises and its licensors.

The logo design tools provided on this Site employ a limited number of elements, including icons, fonts, color schemes, and design effects. Amit Enterprise reserves the right to use all such elements and to make all such elements available for use by other parties in the future. You do not obtain any right or claim to any of the individual logo design elements through your creation of a logo design and/or your incorporation of a logo design into one or more products. Other Amit Enterprise customers may use the design tools to create logos that have similar or identical combinations of these elements and Amit Enterprise does not guarantee that your logo will not have similarities to logos designed and used by other parties. Amit Enterprise provides no warranty of any kind that logo designs created using the design tools will not infringe, or be subject to a claim of infringing, the trademark or other rights of another party. It is solely your responsibility to obtain the advice of an attorney regarding whether the logo design is legally available for your use and does not infringe the rights of another party.

Shipping Policy

These Terms of Use govern any sale to the exclusion of any other terms, including any terms and conditions which you may purport to apply under any purchase order, confirmation of order or other document. Amit Enterprise employees are not authorized to make any representations concerning Products unless confirmed by Amit Enterprise in writing.

Amit Enterprise reserves the right to reject any order without the obligation to assign any reason for doing so. No order shall be deemed accepted by Amit Enterprise unless and until it is confirmed unconditionally.

You agree that all details provided to Amit Enterprise for the purpose of a purchase will be correct and that the chosen method of payment is your property and that sufficient funds or credit facilities are available to cover the full cost of the Products ordered. Amit Enterprise reserves the right to obtain validation of your payment details before accepting any order.

Amit Enterprise may combine orders into a single shipment or split an order into multiple shipments. Any dates quoted for delivery of Products are indicative only. Time for delivery will not be of the essence of the contract created by these Terms of Use andAmit Enterprise will not be liable for any loss or expenses sustained by you arising from any delay in the delivery of the Products whatsoever caused.

Once you place the order, we will start processing it within 3 to 4 working days. After that, the shipment of the order starts within 7 to 10 days based on the order volume and the delivery is attempted within 5 to 6 working days, depending on the location of the delivery. Use of Site

You are granted permission to access and use this Site and its Content for the sole purpose of preparing, evaluating, and ordering products or services solely through Amit Enterprise(referred to herein as “Products”). No other download, retention, use, publication, or distribution of any portion of the Content is authorized or permitted. Obtaining Products from Amit Enterprise does not entitle you to use any portion of Content apart from the finished Products as they are supplied by Amit Enterprise.

You agree to use this Site in a responsible manner that is in full compliance with these Terms of Use and with your local laws and regulations, including export and import regulations. Without limitation, no portion of Content may be utilized as a trademark or service mark, for any pornographic use, for any unlawful purpose or use, to defame any person, to violate any person’s right of privacy or publicity, to infringe upon any copyright, trade name, trademark, service mark or other intellectual property right of any person or entity. You agree that you will not use the Site to produce Products that are offensive, unlawful, harassing, libelous, threatening, harmful, obscene, malicious or otherwise objectionable. Amit Enterprise may terminate its service to customers found to be using Amit Enterprise to engage in undesirable activities.

You are solely responsible for your use of Content in combination with any other images, graphics, text or other materials you incorporate into your Products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorizations from the owners. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into your Products. By placing an order on this Site, you warrant that you have all necessary permission, right and authority to place the order and you authorize Amit Enterprise to produce the Products on your behalf. You grant Amit Enterprise the right to copy, modify, create derivative works and vectorize any uploaded content (i.e., content you have uploaded) for the purpose of fulfilling your order. Moreover, you warrant that you have sufficient rights to permit Amit Enterprise to copy, modify, create derivative works and vectorize any uploaded content for the purpose of fulfilling your order.

You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account.

Courier Delivery

Deliveries will be performed by a professional courier company engaged byAmit Enterprise. The delivery service is available from 10 am until 8 pm during weekdays only, and no deliveries will be made on weekends or public holidays. We recommend that you use your office address as your physical delivery address if you are not at home during the week. You may be required to sign for delivery and provide a valid form of identification when your order is delivered.

If you are not available to take delivery of your order, we will attempt either one or two more deliveries to the physical address that you provided during the online ordering process and, if still unsuccessful, the courier company, acting on Amit Enterprise behalf, will call you to arrange, in its sole and absolute discretion, for either a further delivery attempt to be made or for you to collect your order from the courier company.

In the event thatAmit Enterprise and/or its duly appointed courier company is unable to contact you, despite all reasonable attempts to do so, using the contact details and/or physical delivery address that you provided during the ordering process, we reserve the right to cancel your order and refund to you the money already paid to Amit Enterprise, less Amit Enterprise’s reasonable administration charges including the cost incurred by us for repeatedly attempting to deliver your order and for arranging for the return of your order.

To ascertain the status of your order, please view your order status under ‘My Account (online Amit Enterprise portal)’.

Delivery Times

Our delivery times will vary between 7 to 15 working days depending on the location and serviceability. While Amit Enterprise is firmly committed to delivering your order within the estimated delivery times, we are unable to guarantee that all orders will be delivered within the stipulated time frame due to unforeseen reasons.

Costs

In the majority of cases, the company provides free delivery but Amit Enterprise, in its sole discretion may charge a certain amount of delivery fee based on the volume of the order and delivery location.

Calculating Delivery Cost: Find your delivery fees simply by entering your delivery address in theAmit Enterprise website’s checkout page, and the Amit Enterprise site will calculate the delivery fees for you.

Our Liability

Amit Enterprise is not liable for any incorrect order or delivery where you make an error in the information that you provide to Amit Enterprise e.g. if you provide the incorrect delivery address or submit an incorrect order. If you do not provide a valid physical address for delivery, Amit Enterprise may cancel your order and refund the purchase price. It may also not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you make your order, and will arrange for cancellation of the order or delivery to a different delivery address.

We take all reasonable steps to ensure that your ordered products are delivered within 2-10 business days. While Amit Enterprise will try to ensure a smooth delivery process, in the event that we are unable to meet the estimated delivery timeframes, you accept and agree that Amit Enterprise will not be liable for any losses, liabilities, costs, damages, charges or expenses arising out of the late delivery of your order. You further acknowledge that the delivery of your order may be impacted by events beyond the control of Amit Enterprise such as adverse weather conditions, industrial action, or an inability to secure labor, power, internet services, network connectivity, materials or supplies.

Refund Policy

Refund is provided on damaged or defective product, wrong item or wrong specifications (size, quantity or design) or cancelled by us due to production limitations or other unavoidable circumstances. Minor differences in color, print alignment, or material finish can occur due to technical limitations. These variations are not considered defects and are not eligible for a refund or return.

A refund will be made to the same issuing bank from where the order amount was deducted. If the payments are made through electronic means like credit card, debit card, wallet, or net banking, the refund will be made using the same payment gateway.

On customer’s request, Amit Enterprise is liable to provide Acquirer Reference Number (ARN) or Unique Transaction Reference Number (UTR) to the purchaser for refunds made to the purchaser. Once your return product meets all our criteria, the refund will be processed from our end within 7 to 10 days.

Return Pickup

If you raise an issue about the delivered product to our customer support team, we ensure an easy, quick, and seamless refund process. You may be requested to return the product as a prerequisite for initiating the refund process. We will do a simple quality check of the delivered items once we take back the product from you before initiating the refund process.

Cancellation Policy

If you have already placed an order successfully on shopzeeness.shop and you want to cancel the order for any reason, kindly call us on our customer care number within 2 hours so that we can put a hold on it immediately and also drop us a mail on info@shopzeeness.shop We can cancel your order till the time it has not moved into processing. After the cancellation of your order we can put the amount into your shopzeeness.shop account, you can use this money in future for placing orders with us. In case you want the amount to be refunded to your source account kindly share the same in your cancellation mail.

Transfer of Title

The customer agrees that the shipping terms for all printed Products are FOB shipping point and ownership transfers to the customer upon shipment. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. For any Product that is to be provided to the customer in an electronic format, the customer agrees that delivery of such Product shall be deemed to have occurred either (a) at the time we transmit the Product via email or other electronic communication addressed to the customer or (b) at the time we transmit a notification to the customer that the Product is available for downloading from the Site.

Indemnification

You agree that you shall indemnify and defend Amit Enterprise and all parties from whom Amit Enterprise has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products that was not part of the standard Site Content.

Disclaimer of Warranty

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU ACKNOWLEDGE THAT OPERATION OF THE SITE MAY NOT BE UNINTERRUPTED OR ERROR FREE. REFERENCES AND LINKS TO PRODUCTS OR SERVICES OF INDEPENDENT COMPANIES MAY APPEAR ON THE SITE. THESE REFERENCES AND LINKS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.

Limitation of Liability 

IN NO EVENT SHALL AMIT ENTERPRISE OR ITS LICENSORS, SUPPLIERS, OR VENDORS, THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT AMIT ENTERPRISE HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SITE OR OF FAILURE TO PROVIDE PRODUCTS OR SERVICES THAT YOU ORDER FROM AMIT ENTERPRISE OR ITS AFFILIATES, INCLUDING WITHOUT LIMITATION, DAMAGES ARISING FROM MISTAKE, OMISSION, VIRUS, DELAY, OR INTERRUPTION OF SERVICE. IN NO EVENT SHALL AMIT ENTERPRISE BE LIABLE OR RESPONSIBLE FOR ANY DAMAGES OR CONSEQUENCES ARISING FROM OR RELATED TO YOUR INAPPROPRIATE OR UNAUTHORIZED USE OF THIS SITE OR IT’S CONTENT.

Amit Enterprise will not be liable in any way for loss, damage, costs or expenses (including loss of profit) arising directly or indirectly from any failure or delay in performing any obligation under this Contract by reason of any event outside of its reasonable control, including, but not limited to, any strikes, industrial action, failure of power supplies or equipment, government action or act of God. The liability of Amit Enterprise and its licensors, suppliers, or vendors, and their respective officers, directors, employees, or agents with respect to any and all claims arising out of the performance or non-performance of Amit Enterprise’s obligations under the Terms of Use, whether based on warranty, contract, negligence, strict liability or otherwise, shall not exceed, in the aggregate, the net purchase price (excluding taxes, shipping and processing) for such products or services. In no event shall the liability include damages for loss of profits or revenue; increased cost of purchasing or providing materials, supplies or services; cost of replacement capital; claims of purchaser’ s customers; inventory or use charges; or incidental or consequential damages of any nature.

Site Feedback

Any comments, suggestions, proposals or other feedback (collectively “Feedback Information”) provided to Amit Enterprise in connection with the operation or content of this Site shall be provided by the submitter and received by Amit Enterprise on a non-confidential basis. All such comments, suggestions, and other information shall become the exclusive property of Amit Enterprise. By submitting any such information to Amit Enterprise, you agree that you are transferring and assigning, at no charge, all of your right, title and interest in the information, including all copyrights and other intellectual property rights. You agree that Amit Enterprise shall be free to use such information on an unrestricted basis.

Governing Law and Severability

Any legal action or proceeding relating to or arising from your access to or use of the Site or order via any Offline Method shall be instituted in Kolkata, India. You agree to submit to the jurisdiction of courts sitting in Kolkata, India and agree that the venue in these courts is proper in any such legal action or proceeding. You agree that the United Nations Convention on Contracts for the International Sale of Goods will not apply to any sale under these Terms of Use. If any provision of these Terms of Use is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
